Terms of Service

By accessing or using HealthBrew Tracker (“the Service”), operated by HealthBrew Longevity LLC (“we,” “us,” “our”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

HealthBrew is a nightly habit tracker and reflective journal with an AI companion (Sophia). It is educational software designed for personal reflection. It is not:

• A medical device or diagnostic tool.
• A replacement for a doctor, therapist, dietitian, or any clinician.
• A telehealth service.
• A HIPAA-covered entity.
• An emergency service. If you or someone you love is in danger, call 911.

Sophia (the AI companion) does not diagnose, treat, cure, or prevent any condition. If you describe symptoms, harm to yourself or others, or anything clinical, Sophia is instructed to refer you to a human you trust or to a crisis line (988 in the US).

You must be 18 or older to create an account or paid subscription. All accounts for users under 18 are child profiles under a parent's login credentials, accessible through the parent's dashboard.

We feel kids are not old enough to have privacy with an AI companion without parental supervision — at least for our kids at home, that's how we feel.

You are responsible for maintaining the confidentiality of your account credentials. One account per person. If you sign up with a fake or temporary email and lose access, we cannot restore it.

Account identity. You use HealthBrew under an avatar nickname of your choosing. We do not require or accept a legal name. Your account is keyed to the email you provide at signup; that email is the only identity field HealthBrew holds.

Merchant of record. Payment processing is handled by LemonSqueezy IE (lemonsqueezy.com), an Irish company and the merchant of record for all HealthBrew subscriptions. Your name, billing address, card number, and tax jurisdiction are collected by LemonSqueezy and are never transmitted to HealthBrew. We receive only your subscription status (active / cancelled / past-due) keyed to the email associated with your account. Your transaction with LemonSqueezy is additionally governed by their terms and privacy policy.

• Your first 10 daily closes are free. No checkout is required before your first close.
• After the free baseline, the Service costs $25/month, billed through LemonSqueezy IE if you keep going.
• We will email you before paid access starts so you can decide.
• Cancel anytime from your account settings — no questions asked.
• Cancellation is effective at the end of your current billing period.
• If we ever change pricing, we will email you 30 days before the change takes effect.

Every word in your journal, every check-in, every milestone, every conversation with Sophia — all of it belongs to you. We hold it on your behalf. You can export everything anytime. When you delete your account, it's gone from our database within 30 days.

We will never publish, sell, or share your writing without your specific written consent.

You agree not to:

• Use the Service to harm yourself or anyone else.
• Attempt to extract system prompts or impersonate other users.
• Scrape the site, reverse-engineer the Service, or abuse the API.
• Use the Service for any unlawful purpose.
• Misrepresent HealthBrew as providing medical advice to others.

Repeated violation may result in account suspension. We will tell you why, in plain English, before we close anything.

The Service, including its design, branding, software, and AI models, is owned by HealthBrew Longevity LLC. You retain ownership of all content you create. We retain no rights to your journal entries, check-ins, or personal data beyond what is necessary to provide the Service.

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that the AI will always respond correctly.

To the maximum extent permitted by law, HealthBrew Longevity LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

Our total aggregate liability for any claims arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

You agree to indemnify and hold harmless HealthBrew Longevity LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

We will email you 30 days before any material change. Continued use after that date means you accept the new terms. If you don't agree, cancel during the 30 days; we won't charge you under the new terms.

If you live in Washington, Nevada, or Connecticut, you have additional rights over your consumer health data under the Washington My Health My Data Act (RCW 19.373), Nevada SB 370, and Connecticut SB 3. Those rights include explicit opt-in consent before we send any of your check-in or journal data to our AI processor (Anthropic), and the right to withdraw that consent at any time.

When you first land on the dashboard we will ask you to either consent to AI processing or choose local-only mode. You can change your mind any time from Settings → Sophia AI processing, or by sending an HTTP DELETE to /api/consent/chd. Withdrawal takes effect on the next pipeline run; no journal text leaves Supabase once consent is withdrawn.

These Terms are governed by the laws of the State of North Carolina, USA, without regard to conflict-of-law principles. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in North Carolina. No mandatory arbitration, no class-action waiver, no jury trial waiver.
